It is unfortunate that people don't even try to understand the issue and just go about complaining it.
Most people can't even differentiate between what is law and what is not. What are difficult things to accomplish and what are not.
It is absolutely imperative that 5882 pass otherwise the situation will continue to exist.
Here are the my estimated waits for EB3-I
PD(end of the calendar year) and its corresponding wait in years
2001 1 year
2002 3 years
2003 4 years (Bad economy in 2002 and early 2003)
2004 7 years (Case surge in 2003 and 2004 due to booming economy)
2005 8 years (fewer cases in 2005 due to PERM)
2006 10 years
2007 12 years
2008 .....
I think we are fighting the wrong fight. I do recognize the whole EB system is unfair and in particular to I/C/M/P.
The letter campaign is a great initiative, but I am not sure if we are focusing on the right problem. By saying that the new "interpretation of the spillover" is cruel to EB3 I/C/M/P is plain wrong. Both old and new interpretations were unfair to EB3 I/C/M/P.
Old interpretation resulted in good forward movement to EB3 ROW while EB2 crawls.
New interpretation results in good forward movement to EB2 while EB3 crawls.
How does EB3 ICMP benefit from both the interpretations?
EB3 is clogged because of the 245i cases. Unless we focus on the exact problem no amount of letters to lawmakers will not yield any result.
Writing letters to lawmakers is not going to provide any impact for this year Here is my reason it takes 3-5 weeks for the lawmakers to get the letters in DC because of special security screening requirements. By the time they receive the letters the Congress would pretty much be done with their term. The best option would be to meet with the lawmakers in their local office or in DC and appraise them of the long wait.
Please do understand that one of the reason USCIS changed their interpretation is because many folks with Ph D's and MS from ICMP where waiting for years to get GC"s and USCIS/DOS looked stupid in explaining the reason for the long wait for such folks. Even in the "visa wastage" hearing in the House immigration committee (on Apr 30) the DOS/USCIS was having trouble explaining the long wait times. One of the witness in the hearing was a PhD from China and had been waiting for years for his GC.
Come on folks. EB2 forward movement is good for EB3's, because EB2 will soon become current and the spillovers will be soon coming to EB3 after EB3 ROW is current. I am anticipating DOS will turn EB2 current in the second half of the year and this will ensure all the spillovers will flow into EB3's because EB2's with PD mid-2007 to now will not be able to clear the NC 180 day barrier. Cheer up folks and let us focus on the real problem getting more number of visa's through recapture.

I am surprised that all other threads are getting updated quite frequently. People are posting question related to their RFE and as usual once they get answer to their problems, they vanish. People are posting jokes on IV, but when it is their turn to call, we've to "bump" this thread and send e-mails to members. So pathetic.
I felt very sad when I read 30000+ members donated some 4000 dollars in last two months. I felt my donation of about 1000 dollars since 2006 is being wasted to answer questions of or to solve the problems of these free riders &/or one question members.

I read on the murthy.com website that the UCSIS needs to go through the Kentucky Consular Center to obtain the PIMS verification. The number for the KCC is 606-526-7500. I am going to try and call them to see if they can give me any information on timelines.
For those people that have not left the US yet, it might be worth it to talk to your lawyers and see if there is any way you can have your names added to this database before you travel - that should eliminate any hassles once you leave the country. Much easier to try and do it from there rather than from here.

You are absolutely right in your thinking. It is a pity. I know people who get approved forget everything thinking that "All is well that ends well" but the fact remains that USCIS was is and will remain the most incompetent and irrational organization on the face of earth....
You are right congressional inquiries are being treated as normal inquiries and they are given standard responses and I have bought this to the notice of my congresssman's office....

The Los Angeles Times (11/11, Watanabe) reports that, according to a report from the Migration Policy Institute, there is "a massive 'brain waste' of highly educated and skilled immigrant professionals who potentially could, with a little aid, help ease looming labor shortages in California and nationwide in healthcare, computer sciences and other skilled jobs." According to the report's findings, "nationwide, more than 1.3 million college-educated legal immigrants are unemployed or working in unskilled jobs such as dishwashers or taxi drivers," and "nearly one-fourth of them, or 317,000, live in California." Anyone have any ideas on what EB3 Rest of World will be in the October Visa Bulletin. My Priority date is OCT 2005 EB3 Rest of World. Do you think I have a long wait?

Like others have pointed out, it looks like that the numbers are being allocated in a different way from before. Does any one know of any article or discussion by a real attorney or some expert on what is going on?
USCIS may be using divide and silence tactics. One can already see the impact of EB2 being as good as current. They probably liked what they saw and are setting up to move back EB3 much more. At this rate EB3 will crawl to death. People will try to jump into EB2 and realignments/adjustments automatically will take place.All good for USCIS.
But, going back to my original question, what are the legal experts saying? Can any legal entity or any type of action force USCIS to explain what the heck is going on?
Yes, at least one immigration attorney disagrees with the current interpretation, however he feels that the laws, as written, gives USCIS/DOS the wiggle room to deflect any lawsuits. Since the law does not deny EB3 the numbers, I think we should start a letter campaign to bear upon USCIS/DOS to take a second look at the law and fine tune their interpretation.
We should also ask other immigration lawyers their thoughts (some who have online chat/discussion).

The orignal text in IMMIGRATION AND NATIONALITY ACT says "Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraph (1), to qualified immigrants who are members of the professions holding advanced degrees or their equivalent or who because of their exceptional ability in the sciences, arts, or business, will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States, an d whose services in the sciences, arts, professions, or business are sought by an employer in the United States.

If revenue from increased fee structure starting July 31 is the reason for making visas unavilable in July, I have a strong feeling that the visas may become current for all categories in the Aug Bulletin.
This is not a NEWS or RUMOR making rounds anywhere. This is a mere speculation on my part. Let's hope for the best but DO NOT get your hopes unrealistically high.

Any way, this pan is simply superb compare to the situation before 10 years. Compare to many phone providers/cable compaines, vonage customer service is simply great, at least in my experience.

I have been pretty impressed with both call quality & customer service for ALLVOI. But I have not used Vonage, so cannot compare the two.
I went from spending $130-140 a month on India calls + phone line to $ 14.99. It couldn't get any better :)

That being said every case is different and gloom and doom scenario should not take over your spirits....I am a cynic by birth and see the glass always half empty but once thing that is different for me is that I never give up......and neither should any of you guys however bad the situation is....be a cynic be a pessimist be a paranoid if you can't help but BE PERSISTENT and UNRELENTING...

I sent a hand written letter to the President and CC'd it to CA IV PO BOX. and I feel a lot better after writing it.
I have also sent a personalized hand written letter to the local Congressman. I will set up a meeting once I get a positive response or in the next few weeks, whichever is earlier.

va_dude, your concerns are understandable. This issue is real and some IV members got affected by this and came forward to provide some more info. pd_recapturing collected that info. A bunch of volunteers are working in the background to move this forward with concrete proof. In the meantime its important to keep sending letters so they know the concern its raising.

Can POJ be only be used for cases that were seperated? Last time, I used the POJ method, the IO told me to talk to the CSR and he refused to give me the status of my case.
